Country star Bailey Zimmerman has issued a public apology as he faces criminal charges for allegedly trashing his New Mexico hotel room, causing $16,000 worth of damage.
Drama erupted for Zimmerman, 26, after he canceled his May 27 show at the Sandia Resort and Casino in Albuquerque due to ‘illness’.
However, per an arrest warrant, Zimmerman was ‘exhibiting signs of intoxication’ during sound check, before allegedly falling off stage.
Zimmerman was later ordered to leave the resort – but is accused of causing huge damage to his hotel room including breaking a phone, piercing a hole in the wall, and leaving a $400 unsettled tab for alcohol.
An arrest warrant obtained by the Daily Mail was issued June 18 with no bond hold, and four days later Zimmerman filed a demand for a speedy trial.
Zimmerman is now facing charges of criminal damage to property and falsely obtaining services. This comes just 17 months after Zimmerman went viral for an off-key drunk performance in Mexico.
In a statement to the Daily Mail, he said: ‘First things first, I want to apologize to the Pueblo of Sandia and to everyone at Sandia Resort & Casino. I never meant for any of this to come across as disrespectful. I am deeply sorry for my actions that transpired.’

‘I respect your community and the hospitality and appreciate the opportunity that was given to me to perform on Native Land.
‘I take full accountability for everything that happened and I am sorry to anyone who feels hurt or disrespected.
‘To my fans who bought tickets and showed up expecting a performance, I am so sorry, you deserved better from me.
‘I understand that being a musician comes with big responsibilities, both on and off stage, and I know that I fell short that day. I am reflecting on the disappointment and concern that I caused.
‘I am taking this legal matter seriously. I am committed to doing the work necessary to learn and grow. Thank you to my fans for holding me accountable and for understanding that I am human. I do not take your support for granted.’
Hotel security allegedly informed police that Zimmerman seemed to be inebriated throughout the evening of the canceled performance, per the affidavit.
Law enforcement say Zimmerman stumbled and fell at his sound check, during which he is also accused of such behavior as hurling cymbals, flinging the microphones to the floor and tipping over part of the drum set.
He is said to have repeatedly stormed offstage and then exited the sound check altogether, in the version of events laid out by the affidavit.

While waiting for his car to return to the resort, he allegedly spat in the direction of a member of security staff, according to the authorities.
Although he supposedly bewailed the fact he had to take a white SUV rather than a black one, he is claimed to have climbed into the vehicle anyway.
He allegedly had a bloody knee once he arrived at the resort, by which point his state was such that one of his shoes slipped off and he walked while leaning against one of the people accompanying him, the authorities claimed.
Zimmerman’s show that night was canceled and a statement was issued on his Instagram page that read in part: ‘I have not been feeling well and have tried to power through, but I’m not able to give you all the show you deserve.’
Meanwhile the affidavit alleges that he was jettisoned from the hotel, which provided a bus to convey him away from the premises.
Zimmerman supposedly refused to comply and hotel staff resorted to calling the police, after which he agreed to board the bus, law enforcement said.
Only the following day did housekeeping arrive at his room and discover it had allegedly sustained about $16,000 worth of damage.
Along with the unpaid $400 alcohol tab Zimmerman supposedly ran up, two chairs are said to be missing and the carpet is said to have been stained.

Among the damaged items are – according to law enforcement – a television, a phone, two chairs, a coffee table and more than one of the walls.
In January 2025, Zimmerman apologized to fans after performing drunk at Luke Bryan’s Crash My Playa festival in Mexico.
He was brutally mocked for singing off-key and knocking over the mic stand.
Days later, he issued an apology to his followers on Instagram and confessed that he was drunk during the performance, stating that he was ’embarrassed’ and wanted to be ‘truthful’ with his fans.
He said, ‘I’d like to talk about something that’s been eating me alive. Last weekend, down in Cancún, Mexico, I’m sure everybody’s seen the videos of me playing absolutely awful and singing absolutely awful and I feel like you guys deserve an explanation from me because you’ve had my back through the highs and lows and through every mistake.
‘I got up on stage, and I was too drunk to play. And I sang awful, I played awful. Nobody got the show that they wanted or paid for. And I’m disappointed in myself.

‘I want to show you guys the person that I truly am. So I’m just asking for a little bit of grace. Man, growing up is interesting. It’s not an excuse, but man, thank you to everybody that’s got my back.
‘Thank you for staying, thank you for showing me love and grace, and we’re gonna crush this year. But yeah, I just wanted to say I’m sorry. I fricken’ love you guys more than anything in the world and I don’t want to lose you. So forgive me, and I love you.’
In December 2025, Zimmerman exclusively told The Daily Mail that the 2025 mishap had ‘changed’ his life for the better – and revealed what he’s doing to ensure it never happens again.
‘It actually was really good for me because it’s changed my life,’ he revealed in an interview with the Daily Mail.
‘I’ve kind of grown up a lot since then and a lot more focused, and all the things that something like that will do to somebody. So yeah, life has been really good.’
Since the incident, Zimmerman said he has taken a different approach to drinking – explaining that he’s now drinking in ‘moderation’ and not mixing business with pleasure.
